I was never expecting anything to come out of the potential SIC review of the APD. However, I figured if they did do an "investigation" they might pretend that it was legit and maybe have some recommendations on things the APD could do to improve. Nope. Apparently the APD is perfect. This is my favorite part.
A public safety committee exists within the Common Council and it has direct and regular contact with APD. Issues such as those raised in your letter are best addressed through that committee, or directly with the chief of police
See, if we as citizens want to get to the truth, we should use the common council. That is the great advice from the SIC. Because there is a Public Safety Committe that will help us. So, if for instance we wanted the truth about the machine gun issue we should ask them to look into it. Remember when the head of the Public Safety Committe shouted down the President of the Council when she tried to question Tuffey about this? I believe he is pretty clear about saying there was no point in looking into this.
"What's the point of bringing this up 10 years ago, all kidding aside," Scalzo can be heard asking Morris on a tape of the meeting. "You smell blood in the water and now you want to go for the blood, that's what it's about."

Last week, Scalzo defended his actions, saying he didn't believe it was proper to talk about the machine guns during a finance meeting. He said the Public Safety Committee, which he heads, will continue to seek answers.
If it wasn't for the judge's findings that Chief Tuffey has failed in his duty in this investigation, this might be frustrating. Instead it just confirms that we are right and we need to get these crooks out of office.

And now as a reminder and to try to do the impossible, that being to publically humiliate the shills at the SIC for insulting the citizens of Albany with this tripe, I will reprint Albany Layman's piece on this issue.
In Oregon, Texas and Michigan, police officers and two prosecutors have been charged with federal firearms and tax evasion crimes for buying guns through their departments[...] [TU, 101707]

Say ... what do you suppose would happen if that same thing happened here in Albany?  Cops obtaining illegal firearms, and doing it through the police department to avoid paying taxes on them?  

What's that you say?  You would guess that nothing would happen, no prosecutions, no comment from The Tan One?  So cynical of you.  So jaded.  And so correct.

Brendan Lyons of the TU has written an excellent series of articles on this scandal.  In the spirit of DIA's dysfunction posts, the following is a chronological look at how we've gotten to this point of Santa not delivering any indictments for the guilty parties.  (Excerpts from the TU articles in italics.)

1993, 1994 and 1995 [TU, 102807]: multiple purchases of federally banned weapons [...] purchased at tax-exempt, discount prices. [TU, 100807]  [F]ormer assistant chief, William M. Murray, [...] signed official departmental letters [stating] "These weapons will be used for official duties only, purchased by the department for departmental use only [...]" [TU,  102807]

December 2002: ATF agents find a machine gun for sale at a local gun dealer.  The gun was registered to the Albany police force [and] had been brought to the store by Michael Romano, who is now a detective with internal affairs. [TU, 100807]

January 2003: Then-Police chief Robert Wolfgang sends a letter to ATF: "Please be advised that the following weapons, registered with BATF to the Albany City Police Department ... are not accounted for," the letter states, listing 12 guns.  "Currently the departmental records identifying the officers who possessed the weapons cannot be located." [TU, 102807]

Unknown 2003: The U.S. attorney's office in Albany was briefed about the matter [...] by the ATF, according to sources familiar with the investigation. U.S. Attorney Glenn T. Suddaby said: "ATF never brought a case to our office. [TU, 100807]

January 2004: Former assistant chief Murray dies.  [P]rior to [his] death he was visited by an Albany assistant police chief, Anthony Bruno, who removed an assault rifle that day. [TU, 112507]

April 2004: Wolfgang out as chief.

July 2004: John Curry, a part-time sheriff's department inspector, [...] went to Murray's home [...] at the request of Wolfgang.  Curry [...] was asked to remove three large artillery shells, including a live one, from the basement.  Curry may or may not have had assistance from the State Police bomb squad.  Curry said he went alone and never documented the incident or notified Watervliet police. [TU, 112507]

December 2005: Tuffey in as chief.

February 2006: The TU files a FOIL request. [TU, 101707]

April 2006: [T]he city denied the Times Union's [FOIL request], stating: "Disclosing the weapons that are used by the police force in fighting crime in the City of Albany could endanger the life of the officers using them against criminals."

At the time the letter was written, city officials would have known their own internal investigation determined the guns were unsuitable for urban policing, had never been deployed or used by the department in any official capacity, and that some of the weapons were missing and had been purchased by individuals other than police officers, according to interviews with people
familiar with the case.
[TU, 082607]

August 2007: TU publishes first article about the scandal. [TU, 082607]  After that publication, Tuffey acknowledged the guns were never used by the department and that there was no policy to use them. Departmental sources said the guns were unsuitable for urban policing and that no officers received formal training on their use. [TU, 102807]  

September 2007: Tuffey goes before the Public Safety Committee and his statements led Common Council President Shawn Morris and Public Safety Committee Chairman James Scalzo [...] to believe all of the guns were recovered and destroyed[.] [TU, 102807]

October 2007: Oct 8: TU reports that there are an unknown number of guns still missing. [TU, 100807]  Oct 10: At a Common Council finance meeting, Tuffey sez: "I never lie and I never will lie. ... I said to you that all the guns we had in our possession were destroyed," Tuffey said. "I don't know how many guns were purchased. ... I don't know. There's no records, guys." [TU, 102807]

October 2007: The [Albany Police Officers Union] served papers [...] seeking to intervene in a Freedom of Information lawsuit filed by the Times Union, which is asking a judge to order the city to release the records. [TU, 101707]  The union says that the identities of the officers who were in on the gun deals should not be made public as a matter of internal job performance or some such shit.

So...

What's you favorite aspect of all this?  The city officially lying in its denial of the TU's FOIL request?  The TU knowing more about how many guns are out there than Tuffey knows?  Suddaby's non-responsive response?  The artillery (artillery!) pick-up that was done at Wolfgang's request, months after Wolfgang resigned?  So difficult to choose.

that the SIC is tainted by the Jennings Administration, or that there are not professional enough to do their jobs.  I like and respect DIA and agree with a number of issues that are discussed, but fair is fair.
There was an investigation of the potential of abuse on the part of some officers and it was found to be nothing. Simple, there are enough other issues that can be criticized.

one of Tuffey's old buddies is on the SIC, that is what i'm saying.

If they did a thorough investigation, there is no way they could say that the Public Safety Commission on the council is doing its job when the head of council yelled at another member for questioning the chief on this issue.

That is ridiculous.

Add on the judge's findings that were reported yesterday and using even an ounce of common sense and I believe we can see that this wasn't a real investigation.

Sorry I don't share your belief in the SIC's ability.

Well now!  

I guess you can file this one under the heading of "Be care full what you wish for."  

You wanted an SIC investigation- You got the SIC investigation.

It would be really easy for me to sit here and laugh at the people who supported these council members when they decided to put their own political posturing and positioning in front of the needs of the city and avoid doing their oversight responsibilities or demand publicly that Soares do his.  It would be really easy to start laughing- but frankly I am just too disgusted to do it.

So here is how this stands:

  1. These six council members blew it and because of their timid actions the much needed investigations and reforms will never happen.  How can it?  These six council members made it politically distasteful for the other members of the council to support them- be it on police issues or any other reform- even if they were initially inclined to.  

  2. Any other investigating body will now rightly reject any further attempts to change the venue for any investigations.  The SIC ruled. No other committee will see the need to get involved in what can clearly be viewed as a local pissing match or will want to be seen as second guessing the SIC.

  3. These council members have wrecked any chance of using police corruption or abuse as a unifying issue in the next campaign.  At least two of the letter signers are rumored  considering running for Mayor. By shirking their responsibilities to begin with (not demanding the Common Council perform their mandated oversight role) it brings to question to ability of these "reformers" to deal with problems they will encounter if they were ever to be elected.   If they will not demand their fellow council members make a fairly easy and- at the time- publicly popular choice to convene an investigation when confronted such obvious problems as posed by the police department how can they be trusted if elected to make the tough if elected Mayor.

The fact that SIC ruled that everything is just ducky here in Albany also raises the question of the judgment of these potential candidates.  They chose the venue. They wrote or signed the letter. They were ruled against. They look like incompetent fools.

  1.  Should Soares now go forward with an investigation or now announce one is underway the public perception will be that it is politically motivated no matter what the truth is. He will be seen as the last ditch attempt to undermine any potential Tuffey campaign.

  2. Tuffey has been vindicated. Completely. No question.  Now anytime someone questions his motives, tactics or whatever the public is going to see it as nothing more than sour grapes.

The reform movement takes another giant step back. Good job.

How about you repeat it at the common council meetings for the next year?

How about you go there and say, "Scalzo, Sano, Casey, et all.  You need to stand up and do what is right?"

How about instead of attacking anyone who says we need to change the way the city does business, you support them?

How about you don't tell us that if Soares investigates Jennings it would be NOW seen as politically motivated and that if these people hadn't written that letter to the SIC no one would've ever said any investigation by Soares was politically motivated?  We aren't as gullible as you seem to think we are.  And you aren't that stupid.  

This was one option.   Now we know it isn't a viable one.   i believe your option was to try to get Scalzo, Sano, Casey, etc to agree to investigate Tuffey?  Was that it?  Was that what you recommended as the best way for us to get the grand investigation you claim to want?    Or did i miss something in your brilliant strategy.

You protest too much.

Your proclamations that Tuffey is now somehow squeaky clean and above any criticism are very funny.  

When you can show me some evidence that you have lifted one finger to get any sort of investigation started, let me know.  Until then, you have zero cred.

Also, if you are implying that I do what i do because you think i hate jennings and tuffey, you are wrong.    I pay taxes for them to do a job.  They do it poorly.   I expect better.   I don't confuse the person with the job.

And DIA: Had the letter been directed to the District Attorney then I wouldnt have had a problem with it.  After all, according the the DAs web site the "Public Intergety Unit" is supposed to be investigating exactly what the Six wanted investigated.

It is all public record.  You can just refer to yourself as "the guy making the case for justice" if you are worried about how being on the record for justice is a bad thing in Albany.   Or, perhaps, that didn't happen.  Or, perhaps?

Many people have said that this blog has had a large impact on Albany politics and the way people think about politics.  How is that for a starting point about what I've done.  Perhaps you think your comments that have just defended the status quo lo these many years are what people are referring to...perhaps you are right?

If you want to believe that I spend all this time on this blog working for change and i do nothing else to try to achieve my goals, be my guest.

Personally, I like David Soares.  Now, whether his office could do a better job, that's a different story.  And one more thing, I am not a Republican.

Mike Stark, a guy who used to post here until he started his own blog and moved to Virginia, made a suggestion (on a blog) that resulted in some quick web organizing.  That organizing led to the presumptive Democratic Presidential nominee writing a response on his shift to support a revision to the Foreign Intelligence Surveillance Act.  Specifically, the rapid blog organizing forced Barack Obama to strengthen and clarify his opposition to civil immunity for telcom companies like AT&T and Verizon who broke the law by helping the Feds (NSA, FBI) spy on US citizens' phone, text and email communications without a warrant.

I was almost impressed until I saw where you got all your information from.  Those "far left" websites are great, aren't they?  They are the reason that moderate Democrats run from progressives, like you.  But keep up the good work, I want you to show everyone just how "far left" you are.

And no, I don't hate FISA, its been around since 1978 ya brainiac - and FISA was meant to clamp down on Dicky Nixon's spying on his enemies. I'm sure Tricky Dicky is one of your biggest heroes as you're such a right-wing nutjob.  I'm pissed that the President and the Attorney General repeatedly broke the FISA law and got away with it for so long.  And I'm also pissed that Verizon, AT&T and the Feds broke the Electronic Communications Privacy Act at the Feds request, and the White House is now desparately trying to get retroactive immunity passed for all this law-breaking.  As I'm sure you know Flewy, there are dozens of persons in the Bush Executive that need to be prosecuted for breaking the law.  Just like you're favorite felon... Scooter Libby - former Chief of Staff to Vice President Richard Cheney.

But breaking the law isn't a big problem for you is it? Naahhh, as a matter of fact, you've advocated it right here on this blog.

Machine-gun scandal ringing any bells for you?  I've got a feeling this week, perhaps on Wednesday, certain FOILed documents from APD may reveal lots and lots of past and recent law-breaking by certain lawless members of APD, Lil'Jimmy Tuffey, and the City's corporation counsel's office.  

Tricky Dick Nixon had to resign, perhaps Lil'Jimmy and Jerry the Tan might soon follow in Dicky's infamous footsteps.

Champ admit it, you and all civil libertarians are furious at Senator Obama's decision to vote for the latest FISA bill - which includes retroactive immunity for phone companies who helped the government spy on American citizens. Obama also took a "centrist" position on two Supreme Court decisions - he condemned the Court's ruling that applying the death penalty to child rapists is unconstitutional, while agreeing with the Court's opinion that struck down the gun ban in Washington DC. And late last week, while maintaining his commitment to end the Iraq War, Obama said he may be flexible about when troops will come home.

Change we can believe in............yeah right!

If Obama does win the election, you and the rest of your progressive friends will be so disappointed.

Most of the dialog that Mike engages in is the "wife beater" type questions and he intentionally makes a spectical of him himself in order to get on TV. If he is your gage of success and involvement I would be a little careful.

Personally I talked to Jerry Brown a few times when he was running, Steve Forbes, Paul Tsongas and Michael Dukakis- both as gov and as pres candidate.  I have also talked to Dick Army, Jack Kemp and Rudy Guliani. I even talked to snapper head for a couple of min on the phone once. He is hard to understand.

Are you impressed?  Me neither. I would rather talk to their staffs. That is who knows whats going on and tells the candidiates what to say and do.

Nixon was from the left wing of the party. Same as Rocky and Javits- all three would be perfectly at home in the left wing of the Democratic Party.

Nixon imposed a substantial amount of legislation on businesses and protected the unions. He spent a substantial amount of money on great society type projects.  

On the personal liberty scale he and Bill Clinton are on the same page.  Clinton wanted to read eveyones emails while Nixon wanted to hear everyones phone calls.

Oh yeah, both of those cases went far, didn't they?  

And one more thing, since Obama is voting for the new FISA bill, does that make him a criminal too?  You know, that Fourth Amendment thing, you're always bitching about.  Or is it just the people you hate, that vote for it?  

Hell lately, it looks like 2 Republicans are running for President.

Ya can't answer because there WASN'T any reasonable suspicion.  The Strategic Deployment Unit cops pulled Lisa Shutter over that night in December 2007 because she "FIT THE PROFILE."

Shutter got her rights violated and then got her privates violated by a city cop on a city street, in public, and you just want everyone to conveniently fughetaboutit.

So who's stupid?

And as far as President Obama's concerned... hell, everybody makes mistakes... and today's was a doozey - but at least having to come back to DC to vote has put Obamathon close to NYC so he can do a quick fundraising swing and raise a couple mil with Hil.

Speaking of mistakes, looks like several dozen APD members not only made some mistakes, but also broke several laws when they used the APD as a front to buy 40 or 50 plus machine guns in the 1990's and then proceded to lose track of the machine guns with several ending up in local gun shops. Looks like Lil'Jimmy Tuffey's gonna have to finally spill the beans and and hand over documents on the APD machine gun scandal to the Albany Times Union. Ooops. Tick tock.

And the Shutter and Royal illegal search cases are just getting started.  Just like dozens of other lawsuits against the APD.... but you don't care about that do ya? You're not paying any of the outrageous taxes in the City of Albany to pay for the dozens of police misconduct cases.  Are ya?

Too bad hard-working Albany taxpayers are still having to bail out the Jerry-Jimmy reign of error.  But 09 is just around the corner.  Woo-hoo!
