APD illegal guns

Looks like we might learn a bit more about this. Unless, of course, the city decides to lie again, or to hold back on delivering the documents as ordered by the court.

A state judge has ordered the city of Albany to give the Times Union copies of records related to the illegal purchase of dozens of machine guns by Albany police officers. [...] Police letters used to order the guns claimed they would be used for "law enforcement purposes," which was false. The guns also were purchased without going through City Hall, and no taxes were paid on the weapons because they were purported to be for a police force. [...] The 12-page order by acting state Supreme Court Justice Roger D. McDonough concludes the city must turn over its files related to the purchases. But the judge ruled the city may redact the names of existing police officers identified in the files as having possessed the guns. [...]
We'll see. I'm skeptical that the city will fully comply. There are layers of ass-covering here. This TU article refers back to the ATF investigation that was shitcanned. It's not just the individual cops on the line, it's Tuffey, the former police chiefs, Jennings, US Attorney Suddaby. That's a lot of officials who won't want the facts out there.
The city has seven days to turn over copies of the files to the court.
So, we'll see what the TU publishes next week.

It's hard work, real hard... and it takes time... (none / 0) (#1)

"Tellingly, Chief Tuffey fails to identify his or the Albany Police Department's actions as a criminal investigation, makes no mention of any criminal charges that might result from the investigation, and does not discuss the effect that statutes of limitations might have on the viability of such prosecutions,"

Gee, somebody actually noticed.

Comply? With what? This? "many if not all of the documents provided to the court came into the possession of the city after the (Times Union's) FOIL requests, and as part of an inquiry conducted by Albany Police Chief Tuffey in response to the first FOIL request." - Judge McDonough

That sounds to me that 'many if not all' documents fall beyond the scope of those indentified and requested by the TU in their foil application. But let's hope that's not so.

I'm sure the release and prompt review of the documents, however few there may be, will produce yet another foil request in the near future by the TU.
